The Services are powered by Shopify.   • Provide, tailor, and improve the Services — perform our contract with you, process payments, fulfil orders, generate content, manage your account, remember preferences, recommend products, and improve the Services.

  • Marketing and advertising — send marketing communications by email, text or post, and show online advertisements based on your activity, where permitted.

  • Security and fraud prevention — authenticate your account, detect and prevent fraud or misuse, and protect public safety.

  • Communications — provide customer support and maintain our business relationship with you.

4. AI-Generated Content and Distribution

If you choose the Standard Option at the time of generation, your Generated Content (including any inputs incorporated into it) may be distributed and published by us on third-party platforms (such as Spotify, Apple Music, Amazon Music, YouTube, Deezer, TikTok, Meta audio libraries, and other digital service providers), under artist profiles owned or controlled by Songai Media FZ-LLC, including "The Songai". Personal information is not deliberately incorporated into publicly distributed content, but you should not include personal data in your inputs that you do not wish to be associated with publicly available works.

If you choose the Private Option, the Generated Content will not be distributed publicly and will remain accessible only within your account or via private access methods we provide.

5. How We Disclose Personal Information

We may disclose personal information to third parties in the following circumstances:

  • Shopify, vendors and service providers that perform services on our behalf (IT, payment processing, analytics, customer support, cloud storage, fulfilment, distribution).

  • Distribution and platform partners — where you have selected the Standard Option, with digital service providers and aggregators required to release Generated Content.

  • Business and marketing partners — including via Shopify-supported personalised advertising. Depending on where you live, you may have a right to opt out of sharing for targeted advertising.

  • At your direction or with your consent — for example, social media widgets or login integrations.

  • Affiliates and corporate group — within Songai Media FZ-LLC and affiliates.

  • Business transactions and legal obligations — in connection with a merger, acquisition, or bankruptcy; to comply with subpoenas, warrants and similar requests; and to enforce our terms or protect our rights.

6. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside. We also use certain Shopify enhanced features that incorporate data from your interactions with our store, with other merchants, and with Shopify. In those circumstances, Shopify is responsible for processing your personal information, including responding to your rights requests for those purposes. The Services may link to websites or platforms operated by third parties. We do not control and are not responsible for the privacy or security practices of such sites. Information you share on public or semi-public venues, including third-party social platforms, may be viewable by others without limitation. Inclusion of such links does not imply endorsement.

The Services are not intended for children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction. If you are a parent or guardian of a child who has provided us with personal information, contact us to request deletion. As of the Last Updated date, we do not have actual knowledge that we "share" or "sell" (as defined by applicable law) personal information of individuals under 16.

Note that the licence and ownership terms applying to Generated Content (including the perpetual licence granted to Songai) survive deletion of an account; we will retain Generated Content and related records to the extent required to exercise those rights and comply with legal obligations.

Depending on where you live, you may have the right to appeal our decision or lodge a complaint with your local data protection authority. EEA residents can find supervisory authority contacts via the European Data Protection Board.

12. International Transfers

We may transfer, store and process your personal information outside the country you live in. Where personal data is transferred out of the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses or equivalent UK contracts, unless the transfer is to a country deemed to provide an adequate level of protection.
